iStockphoto® Contest Rules and Regulations



TO ENTER, YOU MUST READ THE OFFICIAL CONTEST RULES BELOW AND AGREE TO THE RULES BY CLICKING THE CHECKBOX WHERE INDICATED ON THE CONTEST ENTRY PAGE.

NO PURCHASE NECESSARY. VOID WHERE PROHIBITED.

Background: iStockphoto® conducts contests from time to time, the details of which may vary. In addition to the particular elements of the current “FUTURE NOW” contest that are provided on the Site (the “Contest”), the following rules, regulations and guidelines (collectively, the “Contest Rules”) apply to the Contest.

  1. Eligibility: Open only to individuals who are at least the age of majority and who are legal residents of the United States or Canada (excluding Quebec) or of a country or jurisdiction in which the Contest Rules fully satisfy all legal requirements for a contest of this nature. Void outside those jurisdictions and where prohibited by law. iStockphoto, in its sole discretion, shall determine the eligibility of entrants. The following individuals are not eligible: employees, contractors, directors and officers of iStockphoto, prize sponsor Abel Cine Tech, Contest judges, and each of their respective parent, subsidiary and affiliated companies, distributors, advertising or other agencies involved in the administration, development, fulfillment and execution of this Contest (collectively, the “Contest Parties”), and the immediate family members and those living in the same households of each such employee, contractor, director or officer. Eligible contestants may enter multiple Submissions, but may only qualify for one prize. Contestants need not be an iStockphoto contributor, but must sign up as a member. There is no cost for membership and no purchase is necessary.


  2. Contest Schedule: Entries will be accepted from February 5, 2007 – April 30, 2007. Voting will take place from May 1, 2007 – May 8, 2007. Final judging will occur May 10, 2007 – May 15, 2007. Winners will be announced on May 21, 2007.


  3. Contest Terms of Submission: As conditions of entry into this Contest, and by uploading a Submission, you:

    REPRESENT AND WARRANT THAT YOU OWN ALL RIGHTS TO THE SUBMISSION, INCLUDING, WITHOUT LIMITATION, THE VIDEO OR DIGITAL RECORDING, AND THE PERFORMANCE CONTAINED IN EACH SUBMISSION, WITH THE EXCEPTION OF ANY MATERIAL PROVIDED BY ISTOCKPHOTO IN CONNECTION WITH THIS CONTEST;

    REPRESENT AND WARRANT THAT YOU ARE THE INDIVIDUAL PICTURED AND HEARD IN THE SUBMISSION, OR, ALTERNATIVELY, THAT YOU HAVE OBTAINED PERMISSION FROM EACH PERSON WHO APPEARS IN THE SUBMISSION TO GRANT THE RIGHTS DESCRIBED IN THESE RULES, AND YOU CAN MAKE WRITTEN COPIES OF SUCH PERMISSIONS AVAILABLE TO ISTOCKPHOTO UPON REQUEST;

    REPRESENT AND WARRANT THAT YOUR SUBMISSION: (A) IS ORIGINAL AND HAS BEEN LEGALLY OBTAINED AND CREATED; (B) DOES NOT INFRINGE THE INTELLECTUAL PROPERTY RIGHTS, PRIVACY OR PUBLICITY RIGHTS OR ANY OTHER LEGAL OR MORAL RIGHTS OF ANY THIRD PARTY, OR VIOLATE APPLICABLE LAWS OR REGULATIONS; (C) HAS NOT BEEN ENTERED IN OR WON PREVIOUS CONTESTS OR AWARDS; AND (D) HAS NOT BEEN PUBLISHED PREVIOUSLY IN ANY MEDIUM; WITH THE EXCEPTION OF ANY MATERIAL PROVIDED BY ISTOCKPHOTO IN CONNECTION WITH THIS CONTEST;

    Irrevocably grant to the Contest Parties the unconditional and perpetual right to copy, reproduce, encode, store, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse (without limitation as to when or to the number of times), your name, address, image, voice, likeness, statements, biographical material and Submission in any media now known or hereafter developed throughout the world for any purpose, without limitation, and without additional review, compensation, notice to, or approval from you or any other party;

    Agree to indemnify and hold harmless the Contest Parties from any and all claims, damages, expenses, costs (including reasonable attorneys’ fees) and liabilities (including settlements), brought or asserted by any third party against any of the Contest Parties due to or arising out of your Submission, or your conduct during and in connection with this Contest, including but not limited to trademark, copyright, or other intellectual property rights, right of publicity, right of privacy or defamation.


  4. Submission Format and Content Requirements.

    a. Content Requirements: Submissions must consist of an original video, film or animated clip no shorter than 30 seconds and no longer than 3 minutes, which incorporates at least one of the free video clips or still images provided by iStockphoto on the contest page.

    b. No Logos, Trademarks or Other Copyrighted Material. Submissions may not contain recognizable logos, trademarks or other copyrighted elements. All entries must include at least one of 5 free video clips or 10 free still images, which will be available for download on the Contest page. By accepting the Contest Rules & Regulations, Contest participants agree not to use the free clips or images for any other purpose outside of the Contest. The Contest clips & images can be purchased using iStockphoto credits if they are being used outside of the Contest realm.

    c. Other Content Restrictions. Submissions may not contain any watermarks or notices, whether digital or otherwise, obstructing or forming any part of any image. At iStockphoto’s sole discretion, Submissions containing content that is considered obscene, pornographic, defamatory, hateful, or otherwise offensive will be not be accepted in the Contest and will not be eligible for prizes.

    d. Releases Required. Model and property releases are required for all recognizable faces and property. Written copies of such releases must be made available upon request.

    e. Sound/Music. Sound is optional. Any Submissions containing non-original sound or music require proof of authorization to use the sound or music. Written copies of such authorization must be made available upon request.

    f. Language. Submission must be primarily in English.

    g. Submission Format. The maximum file size is 100 MB. Submissions must be made in one of the following formats:

    • web video that has been compressed down but can still be viewed in full size (H.264 .mov or MPEG4 .mp4)
    • 640x480 – SD compressed with H.264 .mov or MPEG4 .mp4
    • 640x360 – HD compressed with H.264 .mov or MPEG4 .mp4
    • animation (computer or camera generated)
    • .avi file extensions can not be accepted


  5. Selection of Winners: Qualified Submissions will be posted on the iStockphoto website. Members of the iStockphoto community will vote online for their favorite Submissions. The twelve (12) Submissions in each category (“Funny” and “Not Funny”) that receive the highest number of votes will be submitted to the panel of judges for final review and selection of the winners. Each contestant may only have one Submission submitted to the judges. In the event that a contestant has multiple Submissions in the top 12 and/or in both categories, the Submission with the highest number of votes will be sent to the panel of judges. In the event of a tie, iStockphoto, in its sole discretion, will select one of the tied Submissions to be sent to the panel of judges. A panel of judges will review the top twelve (12) Submissions in each category and will select the one (1) first place winner, one (1) second place winner, and ten (10) third place winners. Submissions will be judged based on the Contest criteria. In the event of a tie among the judges, iStockphoto, in its sole discretion, will select the winner(s). The odds of winning depend upon the total number of Submissions and each Submission’s perceived quality, creativity and artistic merit. iStockphoto reserves the right to disqualify Submissions for failure to comply with Contest requirements, including without limitation contestant ineligibility, failure to produce releases upon request, and for any other reason. All decisions of iStockphoto with respect to the Contest are final.

  6. Notification of Winners. The winners will be notified by e-mail or regular mail and must sign and return a confirmation of eligibility and compliance with these Contest Rules, any required releases, and any other requested documents within the time period stated in the documents. Failure to comply with this requirement may result in disqualification. Any notification returned as undeliverable may result in disqualification. In the event of a dispute about the identity of a winner, entries will be deemed to be submitted by the member of record for the member ID associated with the Submission.

  7. Prizes. All import duties and taxes associated with the receipt or use of the prizes are the sole responsibility of the winner. iStockphoto reserves the right to withhold any taxes as required by applicable law. Prizes are not transferable. No substitutions (including for cash) are permitted, except that iStockphoto reserves the right to substitute prizes of equal or greater monetary value if for any reason a prize cannot be awarded as contemplated in these Contest Rules. The winner may be required to supply a Social Insurance Number or equivalent taxpayer ID if outside Canada prior to the award of the prize. Winners are also responsible for any import tariffs depending upon their jurisdiction of residence, and all transportation to and from the venue where the prizes may be enjoyed.

    Members can submit as many entries as they like in both categories but can only appear once on the 2 shortlists combined (the submission with the highest # of votes will determine which one makes the shortlist for judges to review).

    Members can submit as many entries as they like in both categories but can only appear once on the 2 shortlists combined (the submission with the highest # of votes will determine which one makes the shortlist for judges to review).

    3rd Prize:
    The top 12 entries (voted on by iStockphoto members) will receive 50 free credits for iStockphoto.


  8. Disclaimer and Limitation of Liability. ISTOCKPHOTO MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING ANY PRIZE OR CONTESTANT’S PARTICIPATION IN THE CONTEST. ISTOCKPHOTO SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS, DAMAGE, COST, OR INJURY THAT ARISES FROM OR RELATES TO PARTICIPATION IN THE CONTEST, OR WINNING OR USING A PRIZE, INCLUDING BUT NOT LIMITED TO: (1) LATE, LOST, DELAYED, DAMAGED, MISDIRECTED, INCOMPLETE, OR UNINTELLIGIBLE SUBMISSIONS; (2) TELEPHONE, ELECTRONIC, HARDWARE OR SOFTWARE PROGRAM, NETWORK, INTERNET, OR COMPUTER MALFUNCTIONS, FAILURES, VIRUSES OR DIFFICULTIES OF ANY KIND; (3) FAILED, INCOMPLETE, GARBLED, OR DELAYED COMPUTER TRANSMISSIONS; (4) THE DOWNLOADING OF ANY MATERIAL IN CONNECTION WITH THIS CONTEST; AND (5) ANY OTHER CONDITION THAT MAY CAUSE THE CONTEST TO BE DISRUPTED OR CORRUPTED. ISTOCKPHOTO RESERVES THE RIGHT, IN ITS SOLE DISCRETION AND WITHOUT PRIOR NOTICE, TO SUSPEND OR CANCEL THE CONTEST OR ALTER THE RULES FOR ANY REASON, INCLUDING WITHOUT LIMITATION, IN THE EVENT A COMPUTER VIRUS, TECHNICAL PROBLEM, OR OTHER UNFORESEEN EVENT ALTERS OR CORRUPTS THE ADMINISTRATION OF THE CONTEST.


  9. Release. BY ENTERING THE CONTEST, YOU AGREE TO RELEASE AND HOLD HARMLESS THE CONTEST PARTIES FROM ANY LIABILITY WHATSOEVER FOR ANY CLAIMS, COSTS, LOSSES, OR DAMAGES OF ANY KIND (INCLUDING WITHOUT LIMITATION, THOSE RELATED TO PERSONAL INJURY, DEATH, DAMAGE TO PROPERTY, INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS, RIGHTS OF PUBLICITY OR PRIVACY OR DEFAMATION) ARISING OUT OF OR IN CONNECTION WITH: (1) ENTERING THE CONTEST; (2) ACCEPTANCE OR USE OF ANY PRIZE; OR (3) OTHERWISE ARISING OUT OF OR RELATING TO THE CONTEST.


  10. Governing Law. The Contest and the rights and obligations of iStockphoto and Contestants is governed by and controlled by the laws of the Province of Alberta, Canada, without reference to the applicable conflict of law provisions. You consent to the exclusive jurisdiction of the courts of the Province of Alberta and federal court with respect to any action, dispute or other matter pertaining to or arising out of the Contest.
