I still don't really understand the issue of property releases, etc. I have a model release for this shopper(my wife). Can this be submitted as editorial since I don't have property releases for the merchandise? Or do I need property releases?


I have several images of her shopping at places, so in general, what can I or can't I do with these type images? Thanks.

Given the amount of commercial stuff on this image it would have to be editorial. And anything editorial needs a property release from the shop/stall whatever to say you have permission to shoot there.

and, while you're here, image has technical issues: Wrong white balance and artifacts due to over sharpenning (which enhanced noise of ISO800 native capture). Those things could be fixed.

Inside a store an identifiable store = Property Release


Logos, Copy on Product, Products = Property Release

OK, thanks. So, basically, in order to get a pic of someone shopping I'll need to get a PR from the store.


And as per Susan, any pic of this type would need to be editorial....even with a PR??

Assuming that the store owns a copyrights to the merchandise that is selling, otherwise you need PR for every product from the manufacturer of that specific product.

I'm sorry to say but I don't think that  the photo is technically correct.I assume it could be editorial.

no ... for a seasonal shot like this, the serious (high volume) contributors don't count on grab shots of relatives at the mall - they start in July and either build a set in their studios or rent a place, hire models, ensure props are free of logos, get all releases in place, and shoot under controlled conditions

Here's a catch with editorial: You MUST disclose location, which automatically requires PR.


Otherwise, without logos and/or identifiable marks, location and merchandise becomes generic.


Most shopping malls forbid commercial photography without permit.

@Tom...well, I guess that's about the same as owning your own store then. Yes, that looks like the way to go. Maybe when I can work full time at this I can do that.


@Slobo...I only need to identify the city/country, right? If I had strictly generic mdse. (although I'm not sure what that would be) I'd be ok with just a model release??

You don't need to specify location at all if it is generic image, but if it is editorial you must specify exact location, including the store name.
