That's not true - the TOS cannot override national or state privacy/copyright laws. There are some big hurdles for them to overcome in regards to licensing - it's a huge legal task. Flickr tried it and ended up partnering with Getty Images to make it work. Remember, much of the content on IG is of places, people and objects that would require releases. There is no way someone is going to get around the risk licensing a shot of children, for example, without permission.

Cool! Thanks for the clarification. With the amount of pics on IG looks like things are going to be quite tricky for them!

It's claimed here that nothing has changed, although I don't see any reference to publicly shared photos in the new wording.

Deleted forever and ever.

As Zuckerberg and Larry Page would be happy to inform you, nothing is ever deleted forever. Like. Ever.

I never liked Instagram so I didn't upload except maybe some samples. It is obvious that free service like that has to make money somehow.

Yes, it's changed, and it doesn't have to make any delineation between "public" or not.

"you agree that a business ... may pay us to display ... your ... photos ... in connection with paid or sponsored content or promotions, without any compensation to you."

Not only that a royalty free "license", it's a free royalty free license.

I'm pretty sure instagram- Actually we should say Facebook.....will back off this a bit, but In the spirit of things, I deleted my account there. It will be interesting to watch instagram quickly fall to the back of the line after this.

They've just posted this on FB: We've heard you that the updates to our Privacy Policy & Terms of Service are raising a lot of questions. We'll have more to share very soon.
