Absolutely. Those people can easily recognize themselves based on the contextual information here...location, situation, clothing.

We cannot license images like this for commercial use without the permission of the people featured in the image.

Yes, that would be the way to proceed with images like this, keeping in mind that the images need to remain unedited aside from slight color & contrast correction.
