Seriously though; a) the guy is recognizable, b)iStock has a very clear policy on MRs, period c)when an image can be used to endorse anything (maybe this guy is going to be the next model for Erectile Dysfunction), then it sure as hell needs an MR, and 4) its just common courtesy to ask permission and has nothing to do with the litigious nature of americans.

There has only been discussion about a change in policy, but no change has taken place yet.

That image would have been kicked back for a release back in 2002.

The surfer is the main subject of the image and you can see his face for pete's sake.

It absolutely needs a release. You can clearly discern the face viewing at full size.  You can try to put some shadow on his face or use a very very slight blur to see if it makes the face unrecognizable but, franky, it isn't a great shot, the lighting is iffy, there are a lot of much more appealing kitesurfing shots on the site so I'd just kiss this one goodbye. Sorry.

Tirc83, if it's any consolation, The guy in this photo probably would need a model release too, with the "new rules", judging by the back of his head.  In retrospect, though, I don't think I would have bothered even trying to track him down to get one, becuase I've had approximately zero sales of this photo anyway.
