Exclusivity Question

I've been considering exclusivity for my RF images here at iStock.  However, I also sell a lot of Rights Managed (RM) images on various traditional agencies.  Clearly, iStock is willing to ignore the RM stuff.  I know it would be unreasonable to sell iStock "exclusive" RF images on my own website. However, I cannot find an answer to whether it is okay to sell RM only on my own website. Would any of you exlusives mind helping me with this issue?

Yes, you can sell RM wherever you like.

Thanks for the reply — I figured as much. I searched through the forums looking for a clear answer to this issue.

What concerened me was not what the contract said, but what was implied by this statement on the page leading to the contract:

Are there other restrictions?



  • Images, video or audio files may not be sold on the artist's own site (including collections, CD-ROMs, etc).



This particular statement does not specify any particular type of images. No differentiation between RF and RM, it just says "Images ... may not be sold on the artist's own site ..."

The contract itself only mentions that iStock "Exclusive" content cannot be sold on my own website, but can be artisically displayed. I just wanted to be very careful about understanding this issue before deciding about exclusivity.

Are you sure about your answer? (From the fact that you have an enormous number of sales here, and so many icons after your name that I stand in awe, you may well have excellent knowledge)

As long as you are controlling the rights you are licensing, ie, RM, you should be ok. Support will clarify.

Here is a reply I got from Customer Service:

Hi GreenStock,

Thank you for your message.

As long as the license is RM and not RF and they are not images that have been uploaded to iStockphoto, this is not a problem to do as an exclusive artist.

Please let me know if I can be of further assistance.
